Nick Adenhart's driver was legally drunk during the time of the accident that killed 3 people
The Nick Adenhart case just got very complicated, as the driver of the car he was in was also drunk.
Things may have just gotten very complicated in the Nick Adenhart case, where Adenhart and two other people were killed. In a postmortem, it turns out that the driver of the car that Adenhart was in had a blood alcohol level of 0.16, which is twice the legal limit here in California.

There remains no question from witnesses that the individual who hit Adenhart and his group - Andrew Gallo - recklessly ran a red light and caused the tragedy.

But the information that the driver of the car that Adenhart was in was also drunk could make things rather ugly in the courtroom.

Another one of those things that taints a tragedy and casts it in a completely different light.  Somewhat similar to the Donte Stallworth case where clear reckless behavior was involved, but a legal loophole or material fact is found out much later that definitely complicates things.  A definite tragedy for the Adenhart family, but the real lesson here, don't freaking drink and drive, and don't get into a car where the driver has had a few.  Simple as that, and the whole situation is likely avoided.

 that is the last thing the Adenhart family needs to deal with...I hope it doesn't get too ugly for them. No one needs to deal with that after losing a child.

This is very unfortunate, especially for Adenhart's family and friends.  The Gallo will probably face a much lesser charge even though he was at fault.

It's very possible this case could get thrown out or reduced to manslaughter. This is ridiculous.

How very sad that this news will undoubtedly, for a time at least, overshadow the fact that Gallo ran the red light.  Nick and his group had reason to celebrate, given the game Nick had pitched.  However, poor judgement resulted in their deaths.  I'm sure the lawyers for Gallo will argue that the driver's reactions were diminished by alcohol and that, had he been sober, he would have reacted in time to avoid Gallo's car.  That's the reality of lawyers, and unfortunately, having worked for both prosecutors and defense lawyers, I've seen this all too often.

When your driver is drunk, you don't get in the car - pure and simple. His driver could easily have been the murderer in this case, and Adenhart could be the center of controversy. Hindsight is always 20/20, so Gallo will be the murderer no matter what, but unless I see video, I don't know what to think of either side now.

The real "winners" here? The lawyers... this just gives this case the legs to run for years now instead of months, so their billing just gets to go through the roof now!
