The Portland Trail Blazers threaten litigation against any team who signs Darius Miles
The Trail Blazers would like to warn you to stay away from Darius Miles and their salary cap.

The Trail Blazers benefited greatly, financially speaking, when Darius Miles was determined to have sustained a career-ending injury. If Miles plays 10 NBA games this season, the Blazers will be on the hook for his salary again. He has already played 8 games, and the Blazers sent out this message to the league:

Team Presidents and General Managers,

'The Portland Trail Blazers are aware that certain teams may be contemplating signing Darius Miles to a contract for the purpose of adversely impacting the Portland Trail Blazers Salary Cap and tax positions. Such conduct from a team would violate its fiduciary duty as an NBA joint venturer. In addition, persons or entities involved in such conduct may be individually liable to the Portland Trail Blazers for tortuously interfering with the Portland Trail Blazers' contract rights and perspective economic opportunities.

'Please be aware that if a team engages in such conduct, the Portland Trail Blazers will take all necessary steps to safeguard its rights, including, without limitation, litigation.

No fines or lawsuits necessary.  Darius Miles will not be signed, except for maybe by the good people at one of the medical insurance companies who must have a nice big folder with his name on it.  This young man needs to have his own boardgame.

The problem is... how could the Blazers prove that the (hypothetical) team signed Darius Miles "for the purpose of adversely impacting the Portland Trail Blazers Salary Cap and tax positions" and "tortuously interfering with the Portland Trail Blazers' contract rights and perspective economic opportunities"?

Oh yeah... because there's no other reason a team would ever want to sign Darius Miles.

If I'm in the Pacific Conference I am definitely signing Miles at some time this year.  The prospect of dealing with the Blazers four times a year with Aldridge, Roy, Oden and Fernandez for the next 12 years is frightening enough.  Throw in the potential of a big name free agent added to that mix and if I'm the Clippers or Warriors I am taking the risk of a few hundred thousand dollars in attorney's fees to keep the Pacific competitive for the next 10-15 years.

Besides, neither the Clippers nor the Warriors will have a problem justiying the reasonableness of signing and playing Miles when they are consistently starting D-league call-ups.  Last time I checked the only  Kurz I knew was Marlon Brando's character in Apocalypse Now, not a goofy Center getting minutes for the Warriors...

First of all, Portland should face some type of penalty just for offering Miles an 18 million dollar contract to begin with.  Second, how can a team threaten litigation on another team for for tortuously interfering with there contract rights and perspective economic opportunities.  I may be way off with this but isnt that technically what a team does when they are trying to outbid another team for a free agent?
