Ryan Braun wins appeal, will not be suspended for 50 games

2011 NL MVP Ryan Braun has won the appeal of his 50-game suspension for performance enhancing drugs, according to Tom Haudricourt of the Milwaukee Journal-Sentinel.

Braun tested positive in early October for high testosterone levels. A second, independent test a few weeks later was negative, and Braun maintained his innocence throughout the proceedings.

This is the first time anyone has successfully appealed a positive drug test since the MLB started suspending players for positive tests.

Braun instantly shoots to the top 5 in fantasy leagues. Last year, he hit .332 with 33 HR and 111 RBI and had a .994 OPS.

This is huge news for the Brewers, who already lost slugger Prince Fielder to free agency.

That's because they can't prove that it was tampered with. Just like they can't prove that it WASN'T tampered with... which is why the suspension got dropped.

Nope, it's actually not my opinion. It's fact, backed up by countless legal precedents.

No matter how many ellipses you use, or how many irrelevant anecdotes you bring up, the fact remains that the sample was not handled in the exact proper way, and therefore it must be viewed as if it does not even exist, in the legal sense. Welcome to America.

Therefore, it's inadmissible.
Therefore, there is no longer any credible evidence that he's dirty.
Therefore, you can't punish him.

Sometimes the way the justice system works, guilty people do walk - but that's not the point. I know this has nothing to do with sports and it's an incredibly more serious scenario but remember Casey Anthony? Did everybody know she was guilty? Hell yes. Did the justice system work as it was set up and is supposed to? Absolutely. 

Regardless of how we feel about the outcome, there is a certain protocol when it comes to proving something. The burden of proof is on the prosecution. If we should be mad at anybody for "letting a cheater walk", then we should be mad at the people who handled the evidence.

Ryan Braun was found to have used a banned substance. The test samples were compromised or damaged in some way. You can't suspend the guy 50 games for a sample that might not even be his. If he is really innocent, and who knows, then he should go out of his way to prove it. The sport has been so dirty that clearing your name here should be #1 to anyone in this spot.


On the fantasy side. Will his numbers be as good without Prince? Will any of this testing backlash follow him into the season? If so will it effect him negatively? I say if you're happy with your line up, don't give up too much for Braun. I predict a decline in his numbers.

Later today, I'll write a post addressing how dreadfully wrong you are, from a legal and constitutional basis.

Also, a good father would be able to very easily explain what happened in the Braun case, and give his son a valuable lesson about cheating as well as doing one's job in a proper manner to avoid situations like this.

This isn't a case of MLB saying it's all right to cheat. It's a case of protecting the players' basic rights as human beings.

Is it really a sad day, though? What's more important, one suspected cheater getting suspended or the integrity of the system?

If, as it seems was the case here, the samples aren't being treated properly, then there shouldn't be suspensions issued. We're trying to clean up the game here, not have a witch hunt. Not EVERYONE is guilty.

I'll also note that while Braun is cleared legally, so to speak, the court of public opinion doesn't work like courts or arbiters do. With public opinion, it's always guilty until proven innocent, and only if you're proven innocent a way that public likes. So Braun will still face a taint, whether it's legitimate or not, as Jeff_P's posts make clear.

There still doesn't seem to be definitive word on why the appeal was won. Keep in mind if the test hadn't been leaked before the appeals process had been completed, this whole mess would've been avoided.

MLB handled this in a really screwed up way, but note that this was an arbitration panel that ruled for Braun, not anyone at MLB. The league, judging by their statement, is REALLY unhappy.

Whether you agree or not, this decision sets a precedent that you just know is going to cause many more problems down the road for Major League Baseball.  Hopefully they learn next time to keep things confidential until they go thru the whole process on finding out if a player is guilty or not
