FanIQ | Sports Rumors, Gossip, Blogs, News & Discussion ForumsSan Francisco 49ers outside linebacker Aldon Smith’s status was updated from non-football injury list to the active 53 man roster on Thursday. This comes two days after he voluntarily surrendered to Santa Clara County authorities following weapon charges. He is an asset to the team and the team relies on him heavily.

He was absent from five games as he has been at an in-patient facility for the treatment of drug abuse and was under rehab program. As the 49ers are enjoying their bye week, Smith could take the time to hit practice again and be ready for the November 10 game when the 49ers take on the Panthers.

During a party at his residence on June 2012, three felony charges lodged against him on October 9 for illegal possession of an assault weapon. He will be present at court on November 12 and 19 to answer for the illegal weapon charges and for driving under influence (DUI). The NFL has him suspended and will give its own punishment after the law is done with him, as is their procedure.

Jim Harbaugh said that Smith was present with the 49ers brass on Wednesday and they agreed on the point that the Smith would really have to improve his game and attitude to have a chance to play this year, despite his talent.

The team hasn’t had plans to cut him as they have termed him to be on leave for an undisclosed time. This means that they still want him and will most likely give him a shot at the game real soon. Harbaugh said that Smith had already made quite a few leaps for the good and was working on improving himself.

Smith played the 27- loss to the Indianapolis Colts at their home turf on 22 September. Just two days later, he was in jail for DUI and marijuana possession. But Smith wasn’t one to rant and stated that he was sorry for his behaviour, admitted he needed help and went to a treatment facility.
