If you were a clergy or attorney, and a criminal confided in you about a crime they committed, could (Edited 06/28/08 05:12AM by Helen)

Recently I was watching a show on the OJ murder trial from 1994.   A couple days later I got to thinking about a murderer being able to confide in a member of the clergy without consequence of conviction.  I then began to imagine the difficult situation one would be put in, if a murderer admitted guilt to them.   Even though you took an oath of confidence, could your conscience allow you to do your job and not talk to someone about a horrific crime that was told to you in confindence of your job?  Think of the worse case scenario.... what would you do?

+3 thumbs up I think that part of your job as a clergy member or attorney includes bringing the truth to light.  It would definitely take finessing but I would think the people in these professions would be schooled in the proper way to do this without betraying any oaths they took.  I imagine it's a fine line in a lot of situations.

+2 thumbs upI think it would depend on the situation as it was told to me, to be honest. If it was in cold blood and they did it just to do it, I think I would have to find SOME way for it to come out. If it was in self defense or some act committed as a result of of being under some extreme duress (I'm watching the movie Sleepers as I type this, actually...) then I don't know - I don't think it would weigh on my conscience as bad.

   The position of the clergy has been bastardized with all these "Mail-in Religions" but originally it was designed to do a good job.  You have to remember most laws were constructed in the Northeast; largely Irish/English Catholic/Anglican stock which took strong value in the belief of the penitent - priest relationship.  Hence, when laws were written, priests were allowed the right to continue the privacy of confession as construction in faith even into the prison walls and into holding cells of police stations.  In fact, many a prisioner after confession turned to the police with a "clean soul" to confess their crime to the police.  Of course, times and the level of depravity have change in america.

Now, lawyers!  They have a set of LAWS they are to follow, even scummy ones who represent the mob, drug dealers and politicians.  They MUST be able to act knowing their client is or may be guilty, no matter what---by our Constitution; a client is promised fair legal representation!!!!  So, the lawyer must be able to know and still act freely.  However, if the client is to commit an act while under the lawyers tender; he is duty bound  by law to report it to the court---I'm pretty darn sure about that.  The lawyer IS an officer of the court!!!

+1 thumbs upYou do NOT have the right/responsibility to keep felonies to yourself.  It's actually against the law, and the Vatican has also encouraged their priests to use their judgment in how much they keep to themselves.

This is the reason why I never became a lawyer.  The entire concept that you must do your best to win for your client, whether he is right or wrong, is something that I couldn't deal with.  Unfortunately, in order to be a good lawyer, you cannot have strong beliefs in 'right or wrong', you simply must have a strong desire to win at all costs.

 

I cannot say that this is the reason that I am not a member of the clergy, however.

I thought of the worst case scenario which would involve a crime or crimes against  innocent children. In which case I would see to and demand that the person who confided in me would be punished.  Then if anything was to be done to me . Well I would personally feel that I did the right and correct thing.
