Ugh, I just made a long post and now we're on the Gay-Military/Tranvestite-Paratroopers topic ... which makes me wanna point out one thing .... lets see if I can keep it very simple:

In my opinion gays aren't able to be in the Military simply because of the way the UCMJ (Uniformed Code of Military Justice) is written.  In it, "Unnatural Sex Acts" are banned ... meaning pretty much anything other than missionary.  What the gist of the text enables the military to do is punish two individuals, consenting or not, for being caught in sexual acts.  It's much easier to prevent unwanted pregnancies, which as a military allowing women to 'dress-up', it ought to, and it helps significantly in the prosecution of individuals for rape --- considering all types of sexual acts are banned, and adultery is punishable as well, it's a finite way of helping keep the military from "procreating".

In order to accomodate openly gay individuals, the military will have to rewrite this portion of the text, and to be fair to both straight and gays, they'll no longer be able to punish people for sexual acts ... unless they keep the text "outside of the bonds of marriage" .... however, this will still make it much harder to "only" punish someone for raping another ....

And, another thing many are unaware of, under the UCMJ, it is impossible for a man to be raped.  In order to accomodate for gay individuals, that will have to be rewritten as well.

Not saying it's "impossible," but getting a grouping of suits to collectively agree on the writing of such text is quantifiably more difficult than keeping Oprah's weight down!!!   Jus sayin.

Maybe I'm not following you correctly, McWiggle (it HAS been awhile ... my Wiggle-ese is a bit rusty  ), but I don't think it really has as much to do with sexual acts at all.  It's simply about being able to serve openly ... not being able to run around and bone every attractive private you see (pun semi-intended).
From what you're saying, it sounds like the UCMJ needs some revisions ANYdamnway if it doesn't acknowledge that men (straight or otherwise) can be raped.  But that's a separate issue altogether, to me at least.

LMAO

I agree the argumentation over the whole matter has been centered on them being able to be open about it, but I'm pretty sure there's conversations going on in the meetings about having to rewrite that document to accomodate it.

Principally speaking, does it matter if people in the service are openly gay or not?  Not really ... I think the Spartans are a prime example, historically speaking.

But, politics being politics, I think that document has a great deal to do with why very little progress has been over time.

Do I think it's in need of serious revision?  Abso-Fn-lutely!!  Bein in the military, with Clinton as a prime example, should not be enough of a reason for one to be capable of being punished twice!     (Clinton is an example because as "Commander and Chief" the UCMJ was ignored entirely!)
